terms of section 44 (1) of the Competition Act.

The Commission must treat confidentially any information
identified by you in this form, but may refer it to the
Competition Tribunal
to determine whether the information is confidential
in terms of the Act. You will be notified if your claim is referred to the Tribunal.

Until the Tribunal
makes a decision
about your information,
it will be treated as confidential by the Commission, subject to any
public notice requirements
set out in the Act or Rules.
Please see sections
44, 45 and 45A of the Act.

Confidential information
means trade, business or industrial information that belongs to a firm, has a
particular economic value, and is not generally available to or known by others.
