The Competition Commission releases Technical Report of
the Banking Enquiry
The Panel of the Banking
Enquiry, established in 2006 by the Competition Commission of South
Africa to enquire into particular aspects of competition in retail
banking and the national payment system in South Africa, completed its
work in June 2008. The full report of the Panel, which contains
confidential information submitted by some of the stakeholders that have
claimed confidentiality in terms of the Competition Act, was handed over
to the Competition Commissioner, Mr. Shan Ramburuth by the chairperson
of the Enquiry, Mr. Thabani Jali, on 17 June
2008.
On 25 June 2008, the Commission released an Executive Overview of the
Enquiry’s report. The Executive
Overview reflects
all the Panel’s recommendations but does not contain any confidential
information submitted to the Enquiry by stakeholders.
The Competition Commission
released the full, non-confidential version of the Banking Enquiry
Report on 12 December 2008 to enable stakeholders to understand in
greater detail the analysis and
conclusions drawn by the Panel. Confidential information has been
blackened out. It is the view of the Competition Commission that the
affected sections do not materially harm the Report’s legibility or the
reader’s comprehension. It is available for download below, or on CD-ROM
from the Commission’s offices.

Background to the
Enquiry
The decision of the Commission to appoint the Enquiry was taken in
consequence of the findings of a 2004 report by a Task Group chaired by
Dr Hans Falkena and a Research Report prepared for the Commission in
2006 by FEASibilty (Pty) Ltd, an economic research company headed by Dr
Penelope Hawkins and due to continued public concern regarding the level
of charges made by banks and other providers of payment services to
consumers.
The Enquiry, which was officially launched on the 4th August 2006 was
conducted in terms of Section 21 of the Competition Act No 89 of 1998,
was on the record which was made publicly available subject only to the
protection of genuinely confidential information as provided for in the
Competition Act.
All non confidential submissions, transcripts of the public hearings,
presentations made to the Panel and other information relevant to the
Enquiry are available for downloading in the various categories listed
in the left-hand margin of this website. |
